In an asbestos related case in San Francisco, California the plaintiff was awarded $1.36 million in damages as a result of his asbestos lawsuit against Kent cigarettes.
Don Lenney was an ex-smoker, according to him he got mesothelioma from smoking cigarettes with the Micronite, asbestos-containing filters that were used by Lorillard Co. in Kent cigarettes from 1952 to 1956. Mesothelioma is a type of cancer that affects the linings of lungs and leads to development of incurable cancerous cells.
Lenney who is 73 was diagnosed with mesothelioma in November 2009. He got his lung removed as a part of his treatment for mesothelioma. Lorillard originally labeled its Micronite filters as “greatest health protection in cigarette history,” claiming that it removed more tar and nicotine than its competitor’s filters.
Later on it was admitted by the firm that the filters contained highly toxic crocidolite asbestos, also known as “African blue.” It was found by jury that both Lorillard and Hollingsworth & Vose, the filter’s manufacturer were liable for making and selling a product that didn’t perform “as safely as an ordinary consumer would have expected.”
According to the verdict Lorillard was found 35% faulty, it was 25% for Hollingsworth & Vose and rest of the responsibility was laid on the asbestos suppliers, no company was found negligent by the jury. There have been five successful suits against both companies by Kent smokers suffering from asbestos-realted cancer, Lorillard and Hollingsworth & Vose and they have succeeded in asbestos suits majority of times and this was solely due to inability of many plaintiffs who cannot prove that smoked Kents in the 1950s or that the filter’s asbestos fibers caused their mesothelioma.
