Former Kent Cigarettes manufacturer, Robert Cox filed a lawsuit against the Lorillard tobacco company. Diagnosed with malignant mesothelioma cancer, in 2008, Robert Cox claimed that the tobacco company started using a specific cigarettes design, for the cigarettes filter, a certain material that contained asbestos, since 1950.
Cox also claims that the Lorillard Company did not warn the manufacturers about the health risk of using materials and products containing asbestos. Los Angeles jury rejected Cox’s claim, in which he considered that the tobacco company should be held liable in a mesothelioma lawsuit.
The Lorillard Company was formerly filed for lawsuit. Since 2000, the company pass trough six lawsuits, all based on the asbestos cigarette filters, the same reason for which Cox tried to fill out a lawsuit against the tobacco company. Lorillard Company has successfully defended its cause and won all the trials.
Coming back to Cox’s claims, the Los Angeles Court decided after eight weeks of deliberations that the Lorillard Tobacco Company was not liable and did not have to warn Cox about the health risks associated with the asbestos exposure. Expert witness said that at that time, back in 1950, asbestos was considered safe to work with; not knowing at that time that being exposed to asbestos can cause serious health problems such as mesothelioma cancer. “The defense was banned from presenting evidence that demonstrated the amount of asbestos that could enter the lungs from use of the filters”, The Recorder said.
